This disclosure also appears on the first page of every proposal, estimate, invoice, and contract we issue, as required by 22 Tex. Admin. Code § 367.10.


1. Agreement to These Terms

These Terms of Service (“Terms”) are a binding agreement between you and Pounce Plumbing, LLC, a Texas limited liability company (“Pounce Plumbing,” “we,” “us,” or “our”).

They apply when you use our website at WWW.NOW.POUNCEPLUMBING.COM, request or receive plumbing services from us, communicate with us by phone, text, or email, or pay an invoice we issue. If you do not agree to these Terms, do not use our website or request our services.

If you are agreeing on behalf of a business, property owner, landlord, homeowners association, or other entity, you represent that you are authorized to bind that entity, and “you” includes that entity.

Please read Section 13 carefully. It requires most disputes to be resolved by individual binding arbitration and limits your ability to participate in a class action. You may opt out within 30 days.

Our Privacy Policy is incorporated into these Terms by reference.


2. Definitions

  • “Services” means plumbing diagnosis, repair, replacement, installation, maintenance, inspection, and related work we perform.
  • “Property” means the address where Services are performed.
  • “Work Order” means the written or electronic estimate, proposal, invoice, or service agreement describing the Services, scope, and price for a specific job.
  • “Customer” means the person or entity requesting the Services and responsible for payment.

If a Work Order conflicts with these Terms, the Work Order controls for that job only, and only as to the specific conflicting provision.


3. Website Use

3.1 Permitted Use

You may use our website to learn about our Services, request an appointment, request a quote, communicate with us, and pay invoices. You may not use it for any unlawful purpose.

3.2 Our Intellectual Property

The Pounce Plumbing name and logo, the “POUNCE PLUMBING” mark, our website content, photographs, service descriptions, pricing structures, checklists, process documentation, and all other materials are owned by Pounce Plumbing, LLC and protected by trademark, copyright, and trade secret law. Nothing in these Terms grants you any license to use them.

You may not use our name, marks, or any confusingly similar name or mark in connection with plumbing or any related trade; register or use a domain name, social media handle, or business name incorporating our marks; copy our website content, forms, checklists, pricing sheets, or process documentation; or represent yourself as affiliated with, authorized by, or a franchisee of Pounce Plumbing. We enforce our marks.

3.3 Your Content

If you submit a review, photograph, testimonial, or other content to us or about us, you grant us a non-exclusive, worldwide, royalty-free, perpetual, transferable license to use, reproduce, and display it in our marketing, and you confirm the content is your own and accurate.

3.4 Job Site Photography

We photograph and video work areas, existing conditions, and completed work for diagnosis, estimating, quality control, warranty, permitting, and training. We may use de-identified images in marketing. We will not publish images that identify your address, your face, or the interior of your home in marketing without your written permission.

3.5 Prohibited Conduct

You may not attempt to gain unauthorized access to our systems, scrape or harvest data from our site, submit false service requests, interfere with our operations, or transmit malicious code.

3.6 No Advice

Website content, including troubleshooting articles and maintenance tips, is general information only. It is not a substitute for a licensed plumber inspecting your specific system. Do not rely on it to perform work yourself.


4. Requesting and Scheduling Services

4.1 Service Area

We serve McKinney and surrounding communities in Collin County and North Texas. We may decline any job for any lawful reason, including scope, distance, safety, code constraints, or inability to obtain required permits.

4.2 Diagnostic and Dispatch Fee

We charge a diagnostic fee of $179 to send a licensed technician, evaluate the issue, and provide a written estimate. This fee is disclosed when you book and is due whether or not you proceed with the recommended work. We apply the diagnostic fee toward the cost of the repair if you approve work during the same visit.

4.3 Appointment Windows

Appointment times are arrival windows, not guarantees. Emergencies, traffic, permit delays, and jobs running long can push a window. We will contact you if we are running late. We are not liable for losses caused by a delayed or rescheduled appointment.

4.4 Access to the Property

You must provide safe, lawful, and unobstructed access to the work area, including clearing stored items, securing pets, and providing gate codes or keys. If you are not the owner of the Property, you represent that you have the owner’s authorization for the work. An adult 18 or older must be present unless we agree otherwise in writing.

If our technician arrives and cannot access the Property or the work area, or if conditions at the Property are unsafe, we may leave and charge the diagnostic fee or a trip charge of $179.

4.5 Cancellation and Rescheduling

You may cancel or reschedule at no charge by contacting us at least 4 hours before your appointment window opens. Later cancellations, or a technician arriving to find no one home, may incur a trip charge of $179. This is separate from the three-day cancellation right described in Section 7.

4.6 After-Hours and Emergency Service

Work performed outside 7:00 a.m. to 6:00 p.m., Monday through Friday, on weekends, or on holidays is billed at our published after-hours rates, which we disclose before dispatch.


5. Scope of Work, Estimates, and Pricing

5.1 Written Approval Required

We perform only work you have approved in writing (including electronic signature, email, or text confirmation) on a Work Order. Verbal approvals will be documented in writing and sent to you before work proceeds where circumstances allow.

5.2 Flat-Rate Pricing

Most of our work is priced flat-rate per task rather than hourly. The price quoted on an approved Work Order is the price you pay for the scope described, regardless of how long the task takes, subject to Sections 5.3 and 5.4.

5.3 Concealed and Pre-Existing Conditions

Plumbing systems are largely hidden inside walls, floors, ceilings, and the ground. Our estimates are based on conditions visible and reasonably discoverable at the time of the estimate. We may encounter conditions that were not and could not reasonably have been known, including but not limited to corroded, undersized, brittle, or non-code-compliant existing piping; prior unpermitted work; polybutylene, galvanized, cast iron, or Orangeburg materials; asbestos-containing materials; concealed leaks and resulting water or mold damage; root intrusion; slab or foundation movement; unmarked private utility lines; and unexpected soil, rock, or groundwater conditions.

If we encounter such a condition, we will stop, explain the finding, and provide a revised written estimate. We will not proceed with additional work or additional cost without your written approval. If you decline, we may stop work and you remain responsible for the value of work already performed and for making the site safe.

5.4 Change Orders

Any change to scope, materials, or price must be documented in a written change order approved by you before the changed work begins.

5.5 Estimate Validity

Written estimates are valid for 30 days unless stated otherwise, and are subject to change if material prices change materially, if the scope changes, or if conditions at the Property change before work begins.

5.6 Permits and Inspections

Where the City of McKinney or the applicable jurisdiction requires a permit, we pull it under our RMP’s license and schedule required inspections. Permit fees are billed to you at cost unless the Work Order says they are included. You must allow the inspector access. We are not responsible for delays caused by permit offices or inspectors, and we do not warrant that any inspector will approve pre-existing conditions we did not install.

5.7 Restoration Is Not Included

Access to plumbing frequently requires cutting drywall, ceilings, tile, cabinetry, concrete, or landscaping. Unless your Work Order expressly includes restoration, we are not responsible for patching, texturing, painting, tile or stone matching, flooring repair, cabinetry repair, concrete finishing, or landscape restoration. We will make reasonable cuts and leave the site broom-clean. We will tell you before we cut.

5.8 What We Do Not Do

Unless expressly stated on a Work Order, we do not perform mold remediation, asbestos abatement, structural or foundation repair, electrical work, HVAC work, septic system work, well work, or water damage restoration. We will refer you to appropriate licensed trades.


6. Payment

6.1 When Payment Is Due

Payment in full is due on completion of the Services unless the Work Order states otherwise. For larger projects we may require a deposit of up to 50% and progress payments at defined milestones.

6.2 Accepted Methods

We accept cash, check, and major credit and debit cards. Third-party financing may be available through a lender; financing terms are between you and the lender, and we are not responsible for their decisions, rates, or terms.

6.3 Late Payment

Balances unpaid more than 30 days after invoice date accrue a late charge of 1.5% per month or the maximum rate permitted by Texas law, whichever is less. Returned checks incur a fee of $30.

6.4 Collection Costs

If we must refer an unpaid balance for collection or file suit, you are responsible for our reasonable attorney’s fees, court costs, and collection costs to the extent permitted by Texas law.

6.5 Disputed Charges

Initiating a chargeback without first contacting us does not relieve you of the obligation to pay for work performed, and we will contest chargebacks for completed work.

6.6 Lien Rights

We reserve all rights available to us under Chapter 53 of the Texas Property Code, and will provide any statutory disclosures and notices required for residential construction contracts.


7. Your Three-Day Right to Cancel

If we solicited the sale at your home or another place that is not our place of business, and you agreed to the purchase there, Texas law may give you the right to cancel.

Under Chapter 601 of the Texas Business & Commerce Code, you may cancel a covered transaction at any time before midnight of the third business day after the date of the transaction. Where this right applies, we provide you a written notice and two copies of a completed Notice of Cancellation form at the time you sign, and any deposit you have paid will be refunded within 10 business days of our receipt of your cancellation.

To cancel, sign and date the Notice of Cancellation form and deliver it to us at the address on the form before the deadline.

Emergency and urgent work. If you need work performed inside the three-day window, we will ask you to confirm that in writing before we begin. Confirming does not waive any right you have under Texas law. Texas law limits a merchant’s ability to obtain a waiver of these rights, and we do not ask you to waive them.

This right is separate from, and in addition to, the cancellation and rescheduling terms in Section 4.5.


8. Warranty

8.1 Workmanship Warranty

We warrant our labor and workmanship for one (1) year from the date the Services are completed, or for the period stated on your Work Order if longer. If a defect in our workmanship appears within that period, we will re-perform the affected work at no charge for labor.

8.2 Parts and Equipment

Parts, fixtures, water heaters, and equipment carry only the warranty offered by their manufacturer. We pass through manufacturer warranties to you and will assist with claims, but we do not warrant manufactured goods ourselves. Labor to remove and reinstall a warranted part after our workmanship warranty period is billable.

8.3 Customer-Supplied Materials

If you supply the fixture, part, or equipment, we provide no warranty of any kind on that item or on the labor to install it, and we are not responsible for damage resulting from its failure. We may decline to install customer-supplied materials.

8.4 What the Warranty Does Not Cover

Our warranty does not cover: normal wear and tear; damage from freezing, flood, storm, fire, earthquake, or foundation or slab movement; damage from misuse, abuse, neglect, or failure to perform routine maintenance; damage caused by anyone other than us working on the system; root intrusion, corrosion, scale, hard water, or water chemistry; pre-existing conditions or portions of the system we did not install or service; clogs or stoppages caused by improper items entering the drain; sewer and drain cleaning, which is inherently temporary and is warranted only as stated on your Work Order; or any work for which you have not paid in full.

8.5 Making a Claim

You must give us a reasonable opportunity to inspect and correct the issue before hiring anyone else. If you have another party perform warranty work without giving us that opportunity, the warranty on the affected work is void and we will not reimburse the cost.

8.6 Transferability

Our workmanship warranty is non-transferable and applies only to the original Customer at the original Property.

8.7 Disclaimer

Except as expressly stated in this Section 8, we disclaim all warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the maximum extent permitted by law. Nothing in these Terms waives or limits any right you have under the Texas Deceptive Trade Practices–Consumer Protection Act, which cannot be waived except as that statute allows.


9. Aging Systems and Assumption of Risk

Working on an existing plumbing system carries inherent risk. Old, corroded, brittle, or improperly installed pipes and fittings can fail when shut-off valves are turned, when pressure changes, or when adjacent components are disturbed, even when a plumber uses reasonable care.

You acknowledge that where we work on an existing system, components we did not install may fail during or after our work, and that this is a risk of the system’s condition rather than a defect in our work. We will tell you when we see this risk before proceeding, and we will document it on the Work Order. This section does not limit our responsibility for our own negligence.


10. Limitation of Liability

To the maximum extent permitted by Texas law:

(a) Our total liability arising out of or relating to any job is limited to the amount you paid us for that job.

(b) We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost rental income, loss of use, hotel or relocation costs, or damage to business reputation.

(c) We are not liable for damage arising from conditions we did not create and were not hired to correct, including pre-existing leaks, foundation movement, or code violations in work performed by others.

(d) These limitations do not apply to personal injury or death caused by our negligence, gross negligence, willful misconduct, or fraud, or to any liability that Texas law does not permit us to limit, including under the Texas Deceptive Trade Practices–Consumer Protection Act.

You should maintain homeowner’s or property insurance covering water damage. Where damage is covered by your insurer, you and your insurer agree that recovery is subject to the limits in this Section.


11. Insurance

We maintain commercial general liability insurance in at least the amount required of a Responsible Master Plumber by the Texas State Board of Plumbing Examiners, along with workers’ compensation coverage for our employees where applicable. A certificate of insurance is available on request.


12. Construction Defect Claims — Required Notice

If you believe our work on your residence is defective, Chapter 27 of the Texas Property Code requires you to give us written notice by certified mail, return receipt requested, at least 60 days before filing suit or initiating arbitration. The notice must describe the defect in reasonable detail.

You must give us and our representatives a reasonable opportunity to inspect the alleged defect, and we have the right to offer to repair it or to settle by payment. Send notices to:

13. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

13.1 Talk to Us First

Most problems are solved with a phone call. Where Section 12 applies, its 60-day notice requirement applies in addition.

13.2 Binding Individual Arbitration

If we cannot resolve a dispute informally, you and Pounce Plumbing agree that any dispute arising out of or relating to these Terms, our Services, our communications with you, or our website will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Collin County, Texas. The Federal Arbitration Act governs the interpretation and enforcement of this section.

13.3 Class Action Waiver

You and Pounce Plumbing each waive the right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this Section 13 still applies to all other claims.

13.4 Exceptions

Either party may bring an individual claim in small claims court in Collin County if it qualifies. Either party may seek injunctive relief in court to protect intellectual property or confidential information. Nothing here prevents you from reporting a concern to the Texas State Board of Plumbing Examiners, the Texas Attorney General, or any other government agency.

13.5 Your Right to Opt Out

You may opt out of arbitration and the class action waiver by sending written notice within 30 days of the date you first accept these Terms, to Pounce Plumbing, LLC, Attn: Arbitration Opt-Out, Pounce Plumbing LLC, 3801 N Central Expy, STE 103, McKinney, TX 75071 Phone: (469) 772-5766 Email: info@pounceplumbing.com. Include your name, address, and the Property address. Opting out will not affect your service, your pricing, or your warranty in any way.


14. Text Messaging Terms

By providing your mobile number and giving consent, you agree to receive text messages from Pounce Plumbing at that number.

  • Service messages include appointment confirmations and reminders, technician dispatch and arrival notices, scheduling changes, quotes, invoices, payment confirmations, warranty information, and replies to questions you have asked us.
  • Marketing messages, including special offers, seasonal maintenance reminders, and review requests, are sent only if you separately opted in to marketing messages.
  • Consent to receive text messages is not required to receive service or as a condition of any purchase.
  • Message frequency varies. Message and data rates may apply.

  • Carriers are not liable for delayed or undelivered messages.
  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details on how we handle mobile data.

You are responsible for notifying us if your mobile number changes or is reassigned. Do not use text messaging to report an emergency; call us at (469) 772-5766.


15. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including severe weather, freeze events, flooding, fire, utility outages, municipal water shutoffs, labor shortages, supply chain disruption, manufacturer backorders, permit office delays, government action, or public health emergencies. During regional freeze or storm events, we prioritize by severity and may not be able to meet normal response times.


16. Assignment

You may not assign these Terms or any Work Order without our written consent. We may assign these Terms, any Work Order, and our rights and obligations under them, in whole or in part, to any successor in interest, including in connection with a merger, acquisition, reorganization, financing, or sale of all or substantially all of our assets, without your consent. Your warranty rights under Section 8 will be honored by any such successor.


17. General

  • Entire agreement. These Terms, your Work Order, and our Privacy Policy are the entire agreement between us and supersede any prior discussions, marketing statements, or verbal representations.
  • Severability. If any provision is held unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Governing law and venue. Texas law governs, without regard to conflict-of-laws rules. Subject to Section 13, the exclusive venue for any action is the state or federal courts located in Collin County, Texas.
  • Notices. Notices to you may be sent to the email, mailing address, or mobile number you provided. Notices to us go to the address in Section 18.
  • Headings. Section headings are for convenience and do not affect interpretation.
  • Survival. Sections 3.2, 6, 8, 9, 10, 12, 13, 16, and 17 survive completion of the Services.

18. Changes to These Terms

We may update these Terms. The version in effect on the date you approve a Work Order governs that job. For website use, the version posted governs. We will update the “Last Updated” date, and we will notify you of material changes by email or text where we have your contact information. Continued use of our website or Services after an update means you accept the revised Terms.
